Regulation of international road transportation in the EU

The licensing of international road transport in the European Union is set out in Regulation (EC) No 1072/2009 of the European Parliament and of the Council of 21 October 2009 establishing common rules for access to the market for the international carriage of goods by road. According to this Regulation, all carriers engaged in international road freight transportation must obtain a European license confirming the right to perform such transportation within the EU.

Basic requirements for a European license:

The carrier must be registered in accordance with EU legislation and meet the requirements established for international road freight transportation.
A copy of the Euro license is issued for each vehicle used by the carrier, which the driver must carry during transportation.
The validity of the European license can last up to 10 years, but its holders are subject to inspections by regulatory authorities to confirm compliance with the conditions.

The European Union has significant powers in this area, in particular, it determines the general rules of transportation, the conditions for the provision of transportation services to non-residents, as well as security measures. Compliance with these rules is critical, as any violations may result in sanctions or even loss of the license.

Sanctions for non-compliance with road transportation rules in the EU

The CMR is issued in at least three copies and requires the signatures of both the shipper and the carrier.
This document is the main proof of the fulfillment of the contract of carriage in the legal sense, so it is mandatory for every international transportation.
The CMR consignment note has a standardized form developed by the International Road Transport Union (IRU) after the CMR Convention came into force, so its form is almost identical in all EU countries.
